Maintenance Diagnosis and Inspection Responsibility

Tenant shall promptly notify Landlord of maintenance issues. For non-emergency concerns related to HVAC, plumbing, appliances, electrical systems, or other equipment in the property, Tenant shall be responsible for the cost of the initial diagnostic inspection or service call by a licensed professional, up to a maximum of $250 per occurrence. If the inspection determines the issue is due to normal wear and tear or mechanical failure of the system, Landlord shall be responsible for repair costs beyond the initial $250 diagnostic amount. If the issue is due to Tenant misuse, lack of maintenance, or no defect is found, the diagnostic and service charges shall remain the responsibility of the Tenant.

Swimming Pool Maintenance Diagnosis and Inspection Responsibility

The swimming pool is provided as a premium amenity for Tenant enjoyment. Tenant shall be responsible for routine maintenance of the pool, including cleaning, maintaining proper water chemistry, and monitoring equipment operation during the lease term. Tenant shall also ensure the pool is properly winterized before freezing temperatures and opened for the swimming season. Use of a licensed pool service company for seasonal closing (winterization) and opening is strongly recommended.

For pool-related concerns, Tenant shall arrange and pay for the initial diagnostic inspection by a qualified pool professional, up to a maximum of $350 per occurrence. If the written report from the pool professional confirms that the issue is due to normal structural or mechanical failure of the pool system, Landlord will be responsible for repair costs beyond the initial diagnostic amount.

Landlord remains responsible for structural components of the pool such as the pool shell and underground plumbing when failure occurs due to normal wear or age. Any damage resulting from misuse, improper maintenance, failure to maintain water chemistry, or failure to properly winterize the pool shall be the responsibility of the Tenant.

Pool Use and Safety

The swimming pool is provided for Tenants enjoyment and recreational use. Tenant agrees to use the pool responsibly and to supervise all family members, children, guests, pets and visitors while using or being around the pool. Tenant assumes responsibility for the safety of all persons using the pool during the lease term and agrees that Landlord shall not be responsible for accidents, injuries, or mishaps arising from Tenants use of the pool or the use of the pool by Tenants family members, guests, pets or visitors.
